Welcome to Windy City Coffee Roasters, LLC (“Windy City Coffee Roasters,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website located at https://windycitycoffeeroasters.com (the “Site”), including any purchases made through the Site, local delivery arrangements, and shipments made within the United States.

By using the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site.

You may use the Site only for lawful purposes and in accordance with these Terms. By using the Site, you represent that you are at least the age of majority in your state of residence and have the legal capacity to enter into a binding agreement.

You agree not to:

We sell roasted coffee and related products through the Site. All products are subject to availability. We reserve the right to limit quantities, discontinue products, change product descriptions, change packaging, correct errors, and modify offerings at any time without notice.

We attempt to ensure that product descriptions, pricing, and images are accurate, but we do not guarantee that all Site content is complete, current, accurate, or error-free.

When you place an order, you are making an offer to purchase products subject to these Terms. We reserve the right to accept, reject, limit, or cancel any order at our sole discretion for any lawful reason, including product unavailability, suspected fraud, pricing or listing errors, inaccurate account information, or problems with payment or delivery details.

If we cancel an order after payment has been submitted, we will issue a refund of the amount properly charged, subject to the payment processor’s timing and procedures.

All prices listed on the Site are in U.S. dollars unless otherwise stated. Prices, promotions, shipping charges, and availability are subject to change without notice.

Payments may be processed through third-party providers, including GoDaddy Payments and or PayPal. By submitting payment information, you represent and warrant that you are authorized to use the payment method provided and authorize the applicable payment processor to charge the full amount due, including product price, applicable taxes, and shipping charges.

We are not responsible for payment processing errors, outages, delays, or security incidents caused by third-party payment providers.

We offer local delivery and shipment within the United States. Any shipping or delivery timeframes displayed on the Site are estimates only unless expressly stated otherwise.

We are not liable for delays caused by carriers, weather, supply chain issues, incorrect addresses, failed delivery attempts, customer unavailability, or other circumstances beyond our reasonable control.

You are solely responsible for providing complete and accurate delivery and shipping information. If an order is returned, delayed, lost, mis-delivered, or requires additional handling because of incorrect information provided by you, we reserve the right to charge additional shipping or handling fees or deny a refund to the maximum extent permitted by law.

For shipped orders, risk of loss and title pass to you upon our transfer of the order to the carrier, to the extent permitted by applicable law.

All sales are final unless otherwise required by law or unless we determine, in our sole discretion, that a replacement, store credit, or refund is appropriate.

Because our products are food and beverage items and are freshness-sensitive consumable goods:

• we do not accept returns of opened coffee bags or other opened consumable products;
• once opened, the contents begin to lose freshness and cannot be returned, restocked, or resold;
• we do not offer refunds or returns based on taste preference, roast preference, brewing method, or subjective dissatisfaction.

If your order arrives damaged, defective, or incorrect, you must contact us at accounts@windycitycoffeeroasters.com within 3 calendar days of delivery. Your message must include your order number, a description of the issue, and clear photos if applicable.

If you do not notify us within that 3-day period, the order will be deemed accepted and no replacement, store credit, or refund will be owed except where required by law.

If we verify that the order was damaged, defective, or incorrect, we may, at our sole discretion:

• replace the item;
• issue store credit; or
• issue a refund.

Original shipping charges are non-refundable except where the error was caused solely by us or where otherwise required by law.

We are not responsible for refunding or replacing orders for issues caused by:

• incorrect addresses provided by the customer;
• package theft after confirmed delivery;
• carrier delays outside our control;
• failed delivery attempts;
• refusal of delivery;
• storage or handling issues after delivery;
• normal product variation in roast, bean appearance, or taste profile.

Any promotions, discount codes, free shipping offers, or special sales may be modified, suspended, or discontinued at any time unless prohibited by law. Promotions may not be combined unless expressly stated. We reserve the right to cancel discounts or promotional benefits where misuse, fraud, abuse, or technical error is suspected.

All content on the Site, including text, graphics, logos, branding, product names, images, design elements, layout, and other materials, is owned by or licensed to Windy City Coffee Roasters, LLC and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, republish, display, modify, create derivative works from, or otherwise use any Site content without our prior written consent.

If you submit reviews, comments, testimonials, suggestions, photos, or other content to us, you grant us a non-exclusive, royalty-free, worldwide, transferable, sub-licensable license to use, reproduce, adapt, publish, display, distribute, and otherwise use that content in connection with our business, marketing, and operations.

You represent and warrant that you have the right to submit such content and that it does not violate any law or the rights of any third party.

The Site may contain links to third-party websites, services, or tools. We do not control and are not responsible for the availability, content, security, or practices of any third-party sites or services. Your use of third-party sites or services is at your own risk and subject to their own terms and policies.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, ITS CONTENT, AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WINDY CITY COFFEE ROASTERS, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.

We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINDY CITY COFFEE ROASTERS, LLC, ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.

These Terms and any dispute arising out of or relating to these Terms, the Site, or any purchase from us shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law rules.

Any legal action or proceeding arising out of or relating to these Terms, the Site, or any transaction with us shall be brought exclusively in the state or federal courts located in Illinois, in the county where our principal place of business is located, and you consent to the personal jurisdiction and venue of those courts.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
